Man facing execution for Broward murder appeals to U.S. Supreme Court


JACKSONVILLE - A Death Row inmate condemned for the kidnapping and murder of a woman in Broward County in 1983 has filed an appeal with the U.S. Supreme Court to stop his execution.

Attorney Martin McClain filed the appeal today on behalf of John Richard Marek.

Marek is scheduled to die Aug. 19 at Florida State Prison near Starke.

Marek and co-defendant Raymond Wigley were convicted in the slaying of Adella Marie Simmons, whose body was found in a Dania Beach lifeguard shack.

Wigley and Marek offered Simmons a ride to a service station after her car broke down on Florida's Turnpike, but instead took her to a beach, where she was raped and strangled.

Another woman in the car stayed behind and was unharmed.

Wigley was murdered in prison.

Marek was originally scheduled to die by lethal injection May 13, but the Florida Supreme Court put the execution on hold May 11 so he could argue Wigley was the killer.

The court lifted the stay July 16.
