Lawyers try to delay death

Lawyers for convicted murderer and child rapist Mark Dean Schwab have until Wednesday to file any motions to delay his execution.

Schwab attorney Mark Gruber said today’s 4 p.m. deadline to file motions was extended to 4 p.m. Wednesday during a telephone meeting Friday.

Schwab, 38, has spent 15 years on death row following the 1991 kidnapping, rape and murder of 11-year-old Junny Rios-Martinez Jr. of Cocoa.

Schwab is scheduled for execution on Nov. 15.

Schwab's lawyers have told Circuit Judge Charles Holcomb they are looking into mental and lethal injection issues that might affect their client's case.

Lawyers will reconvene Friday in Titusville to discuss Schwab's case. Brevard County Judge John Dean Moxley must issue a ruling in the case by Aug. 31.
