Convicted child killer Mark Schwab is expected to be executed this week.
Schwab has been on death row for almost 15 years following the 1991 rape and murder of 11-year-old Junny Rios Martinez of Cocoa.
His lawyers have filed several last minute motions trying to postpone the execution.
On Nov. 7, the Florida Supreme Court rejected the request.
The most recent motion was made to the U.S. Supreme Court. That court has recently halted executions in other states until it rules on whether there are problems with lethal injection procedures.
The Supreme Court is not expected to take up the issue until next summer.
Fifteen members of Martinez's family said they plan to attend the execution next week.
